14th Amendment debate: Legal citizen or not?

Right now, we are learning about the Progressive Reform Movement in America during the early 1900's. The goal is to reform/change laws to improve the lives of Americans. During this time period, America saw new Constitutional Amendments (16th-18th).
Right now, there is a debate going on in our country over whether or not the 14th Amendment (Rights to citizenship) should be AMENDED. Why you may ask? If this passes, there is a chance children born in AMERICA to immigrant parents (illegal/not citizens) would NOT be considered American citizens.
Due to the heavy influx of illegal immigrants coming into the country, Americans on one side, feel that something needs to be done. Read about the controversy to changing the 14th Amendment from the Article below. Comment on the following questions:

1. Where do YOU stand on the issue? Do you AGREE or disagree with the Birthright Citizenship Act proposal? Why or why not?

  1. I agree that children born from illegal immigrants in the united states should not be granted automatic citizenship. I already dislike illegal immigration so people who come here and have a kid and think there kid is an "American" now are wrong. There wrong to themselves and to there child. To do something so drastic and then get caught and shipped back to your country is stupid.
    I Think that if this amendment is passed immagrants will just try even harder to get here, and we will have alot of non-americans living in the U.S from previous situtations. But if they do pass this they would really need to step up there game and get the U.S on lock down to avoid illegal immigration births. I mean how many people can the U.S. provide for anyways? what happens if we get over crowded because we cant handle illegal births, or even our own births? America is only so big, and we are already thriving with billions.
    To me passing this amendment would be a good thing, because it slows our population growth by alittle. Of course to really slow it down we will have to fix the birth rate of our own country and not while worrying about all the new "americans" being born. Immigration is illegal, and it should not be take this far.

  2. 1. I agree that if a couple illegally immigrates to the US and have a child their child should not be consider a US citizen. This is because if neither parent is here legally why would their child become a US citizen? Instead upon arrival to hospital they should be sent back to the country they originate from. This is because their is no reason that people that don't pay taxes to the US government should receive the benefits.

    2. I think that if it was passed it would decrease the amount of people that came to US solely to give their child citizenship. So it should be a positive aspect in deflecting illegal immigrants there but little to no effect in other aspects.

  3. On this issue I belive that if a child was born here in the U.S. with illegal imagrant as their parents then the children are illegal. i do not belive in the Birthright Citizen Act because this would make many immigrants come to america to just have their kids so that their legal.

    If this amendment was passed i belive that this still wouldnt make a difference in the U.S. becuase their will still be immigrants sneaking in to give birth.

  4. On this issue I beleive that if a child is born in the united states by illegal immigrants they are still illegal. Beacuse if we just let it be then more immigrants would start too flood in the us and it would become heavily populated illegally. Then they would just come here just to give birth to their children just so they can be legal. Then if this occured there would be riots protest debates murders and racial discrimination leading history to repeat itself.


    If the amendment passed I believe that there wouldnt be a difference made in the U.S. but the cliche of immigrants sneaking in the U.S. will not change.

  5. 1. I agree, if a child is born in the united states , it should leagally be an american citizen because technically the child is. I dont think its fair to the child to be shipped all around and the children having no say in it when its obviously not their fault. I think to control this matter and not have it be a problem , they should have a better immigrant system and then they wouldnt have to worry about problems like this.
    2. If this amendment was passed , I feel like it could either go two ways; either no immigrants will try and get in , because they are taking the risk of lossing their child , or more might come in , because they want their child to have better oppurtonities in america and then the child will have full american rights. Overall, I think more will try to sneak in , because basically its an excuse for the parents to have an a legal american citizen child.

  6. 1. I don't believe that illegal immigrants that have a baby here in the U.S. should automatically be given the right to have citizenship. The Birthright Citizenship Act is wrong because the illegals are taking it to their advantage so they don't have to do all the necessary paperwork in order to become legal citizens. Every immigrant should come in the country and fill out the right paperwork so that they can become legal.

    2.If the government really buckled down on this law then I think that the illegal immigrant rate will decrease at a good rate. But if the don't buckle down then there will still be a lot of those illegals that will sneak in and try to get citizenship in an illegal way.

  7. 1. i feel as if this wouldnt be a good idea. it isnt the childs fault that her parents didnt become llegal in the u.s. if she waz born in the united states then she should be considered an american and her parents can be the ones who need citizenship. this would just provide more illegal citizens that are unneccessary.

    2.if this amendment got passed, then there would be more illegal citizens in the united states. more people would still come i think and i feel as if they want their kids to be citizens they would make themselves legal in the US. it wouldnt change much i think because the parents wont really care if their kids arent citizens as long as they dont get caught since they arent legal if that makes sense.

  8. Children born in America to illegal immigrants should not be considered legal unless the parents are at least in the process of becoming legal. Too many parents come to America to give birth to their child so their child can become an American citizen solely for the purpose of being able to stay here themselves. In most cases, it has nothing to do with giving their child a better life, but to have a further excuse to be here. Actually, it puts the child in a worse position because it leaves chance for adoption, and their parents being sent back to their native country.

    If this act were to be passed and enforced, there would be less illegal immigrants in America because it takes a large excuse from illegal foreigners migrating to the U.S.

  9. I believe that children born in the country should be citizens. If they were to pass this law i think that many people would protest on the issue. That is taking away someone's rights to be a citizen just because of who their parents might be and i do not believe that is fair at all.

  10. This act being repealed could be a positive step towards changing immigration laws considering there are so many people in America illegally. Children with illegal parents should not be granted the right of citizenship. The child should end up taking the same citizenship as their mother. When an illegal immigrant births a child at a u.s. hospital that should not automatically give the child and mother rights to live in America. It is unjust for a parent to be given rights to live and receive benefits just for conveniently having an infant in the u.s.

  11. I believe that if a child is born here it doesn't make them a US citizen. Any immigrant can come here illegally, yet it doesn't make them a citizen. Just because two parents bring their child here doesn't make it right. I believe they should go back to where they come from. If they want to live here they should do the things we are required to do such as fill out paperwork and become a citizen and pay the taxes required.

    If the ammendement was passed the amount of illegal immigrants would decrease, yet thats only if the law was enforced because if not, immigrants would still be sneaking in to give birth to their child here so it would be pointless

  12. 1. I disagree with the Birthright Citizenship Act. I think that a child born in the United States, or in a U.S. territory, is an American citizen whether their parent's are illegal immigrant's or not. They are still born in our country, and grow up learning our customs just like everyone else. The only differnce is their parents are not legal citizens, but the child cannot help that, therefore, they should not be punished.

    2. If this act were passed there would be chaos in America. There are so many American citizens that would be affected. If this act was passed people would lose jobs, homes, and there would be double, maybe even triple the amount of homeless people on the streets. It would also be very hard for the government to find every single American citizen whos parents were or are illegal immigrants. America would once again be divided.

  13. 1. I believe that it is unfair that someone born in America is automatically considered an American citizen. It is basically an easy way out for illegal immigrants and that is what a lot of them do so they can stay here. This also means that the illegal immigrants do not pay taxes and there children go to school her for free. Other obligations that we have to fulfill they do not have to do either but now they will not have to leave because their child is an American. Being an illegal immigrant is just setting a bad example for their own kids and teaching them to take the easy way out in life.

    2. If this act were passed I think that less illegal immigrants would come to the united states. Now they are more likely to get deported if they have a kid and some people may not want to take that risk. Although if it is passed it could cause a problem, because the law has always been this way.

  14. I believe if a child is born here then it is not a citizen. Although its born American, the parents are not citizens. The parents will just use their child being born in the US as an excuse to stay.

    If this act were to pass, I think that there will be more illegal immigrants coming over to the United States. If we say it's alright for one person to stay others will think its okay for them.

  15. 1. I personally agree with the act proposal. Mostly because the people who are having these babies are coming over here illegally, so they should not be able to benefit from their wrong-doing. They know it's illegal and unjust, yet they continue to do it. It is clear to them that what they are doing is wrong, when they can have their baby in an American hospital and leave it there, while the parents just go back to live in the country they cam from. It's not fair that hard-working, REAL American citizens have to pay taxes, which essentially help benefit the children of illegals, who don't even pay taxes at all. Also, the illegal children can now get a free education and free healthcare, which is not earned or right, at all.


    2. I think the affect would be that it would give illegals one less reason to come over here, and the illegal children wouldn't be able to take away benefits from children, whose parents who actually pay taxes. However, I believe illegal immigrants are still going to come over in hopes of finding jobs and oppurtunities. So unless there are other laws and acts that do more about not letting illegals come over here in the first place, this only a minor handicap to them.

    I believe citizenship is something that is passed down from generation to generation and should not be granted to those who have parents who are not US citizens. The US is the "melting pot" of the world but every immigrant should have to go through the specific requirements to make them legal, regardless if they were born here or not. If this act was passed we would definitely be a larger populated country. Many jobs would be lost and more illegal immigrants would be in the US.

    1.) i do not think that they should give citizenship to immigrants that have a baby in the counry. The kid would get a free ride and make the tax payers suffer.

  20. 1. I don't think that immigrant parents who decide to have children in the US should have their children given the right of being an american citizen. It doesn't matter if a child is born in America or in any other country, if their parents are illegal immigrants then the child is still native to where ever their parents came from.
    2. There is really no telling what will happen if the ammendment is passed. Even more people might try to come to America or this act might keep people out... it would greatly affect america in either way... We depend on most immigrants to do all of the harder jobs, that would change if this was passed.

  21. i think they should be citizen cause they where born on america's ground the parents are still illegal but the kid should be legal. the native americans would have said "we are born onto the earth to live upton it not to own it" so we shouldnt have a say in this matter whereever he is born he is a citizen case closed.

  23. 1. I totally disagree with immigrants being able to become citizens by having a child be born in America. Why should they be able to become an american when we've fought and died for becoming Americans?
    2. Should this amendment pass, people of America are going to be upset with it. I understand that immigrants are just looking for work and stuff, but we've worked just as hard and they get the hard labor jobs like carpentry, field work, and don't get taxes when we do. It's not fair for all of us. REAL U.S. Citizens went to college, they got their degree, they work hard( especially in this economy) and they get paid, taxed, and/or laid off. Thats how it goes now, and if this amendment gets passed thats just gonna make it worse for Americans.

  24. I hate immigration period. I think we are all human beings and we all have a right to live wherever we choose. But unfourtnately, this is the law. I think that if you are born in America, you are a citizen, rgaurdless if your parents are or not. A lot of people view immigration as a bad thing and say these people have no right to be here, but we have to put ourselves in thier shoes... they only want whats better for thier kids, and third world countries aren't as great as the "American Dream" everyone wants.

  25. I believe that if an immigrated parent has a child in the US it is not considered an American citizen. Even though our country has been through a lot with immigration and our ancestors were illegal immigrants, it's not right for them to be coming over here to have a child. However, they're not here unnoticeably. We're paying for their health and education, they are not convicted for a crime, and they get into colleges over an American citizen.

    If this gets passed I believe it will cause a lot of chaos and controversey between the law and American citizens. Even though illegal immigrants will still cross over to America, passing this amendment will practically be saying that it's okay. Therefore, giving them a reason to come here will make more immigrants illegally come to the United States and cause more problems.

  26. 1. I do not agree with with act. First off illegal immigrants can come to America and get jobs to help our economy, which is great. But then they can receive free healthcare and not pay taxes. How can illegal immigrants have a child that is apparently legal? I think the illegal immigrants should either take the test legal immigrants take or start paying to live in America like most of us.

    2. I think if this act is passed I think the US should boost it's security to lower the amount of illegal immigration. Or this could go the way of the 18th amendment, where illegal amount will increase and become more secretive. Hopefully Arizona's law (racial profiling) will only stay in Arizona though.

  27. We shouldn't change this law because it's been around for so long and its our right. So, I disagree with the Birthright Citizenship Act proposal because it's not the baby's fault that their parents aren't legally in the US, and if the parents really tried that hard to get their child a better life, well then I think they deserve it. Also, if this amendment did pass, you could no longer just have a baby in America. There would be lots of paperwork to fill out every time someone has a baby so the baby could be a US citizen. If you were a mother that wanted to remain anonymous when she has her baby, she probably couldn't anymore because she would have to show that she's legally in the US. It would be a lot of hassle and I don't think it's a good idea. Also, this Amendment really won't help that much because illegal immigrants will still sneak in anyway.

  28. 1. I personally do not think that if a child of an illegal immigrant was born in the US, that it is a citizen. That child is still from where ever their parents are from, not America. Also, citizenship is something that should be tested, like have a certain amount requirements before being a legal citizen is attained. Finally there are already too many illegal citizens in the US , and the tax payers pay enough money towards their free ride. Having more immigrants have children in America will be too much mosey for the tax payers to pay.

    2. Should this pass, I think that there will be less immigrants coming over to America, simply because they would know that they actually have to work towards American citizenship. And they couldn't live here without paying taxes and healthcare, which means that they have get jobs and contribute to society.

  29. 1.i think that illegals children if born here are considered citizens because their parents only did it so that later on in life their child can help them out. also i think if illegal immigrants are caught they should have to take the test or get sent back to where ever they are from.

  30. 1.) I personally do not think that giving birth to your child in the U.S. should guarantee its citizenship. If the parents are not legal citizens, the child is also not a legal citizen. To become a legal citizen in our country you must go through a process, and pay taxes, and if you do not do any of these things you are not a legal American citizen. We have certain policies in our country, and if we start changing one, soon we will be changing another, and so on...

    2.) If this amendment was changed our population would increase, and it would be easier for illegal immigrants to come in our country. However immigrants should have their child, and then come to the the country and file to become a legal citizen.

  31. I disagree with the Birthright Citizenship Act. If a child born in the United States, it has the right to be an American citizen whether the child's parent's are legal or illegal. Reality is, weather or not the child is granted citizen ship by the governemtn it will still remain in our country, grow up, and go to school. Immigrants can always find a way around the law so the government might as well make the child a legal citizen so they don't grow up to be like their parents, who don't pay taxes. If the 14th amendment was passed the number of illegal imigrants would not decrease. Immigrants would still come and have children here because legal or illegal they will still have more oppertunities.

    2) If the law is passed it would stopp most of the immigrants from coming here to have kids. But other illegals will still find there way into the united states, so the whole issue with illegals will still be at large.

  33. In my opinion, if the parents of the child are illegal, then the child should also be illegal. Obviously we all immigrated here but that was when America was trying to populate and become diverse. Now it's a different time and we have too many people coming here, so those who are coming illegally should not recieve automatic citizenship for their children born here. They should have to go through the legalization process like everyone else.
    If this ammendment was passed immigrants would continue to come over illegally just to give birth. If I was an immigrant and I could have my child recieve American citizenship in the blink of an eye I would do exactly what they're doing. Soon every immigrant will want their entire families to be American citizens and we just dont have enough room for that.

  34. 1) i feel as if .. immigrants are people we are people what difference does it make if you were born in America or not because no one was put on earth to stay here or not be able to explore the world
    and also america is known to be the best place to live .. and so many things to do here but no .. because we denied them the freedom we work so hard for ...but that doesn't mean keep it all to themselves

    2) so i think if the law is past it would make america look bad.. and i feel as if people from mexico or anywhere else want to come to america so bad they're country should fund it

  35. Well first off i feel that this act is perfect for today's society. The fact that there are several thousands of illegal immigrants in America already for this reason. Just because your illegal parents are here and have you on American soul doesn't make you a legal American citizen.

    I feel that it would better America by limiting the illegal immigrants but in reality it will ruin today's society causing more poverty. This law would end up causing some devastation to America.

  36. 1. I think that if the parents of a child are here illegally, then the child that is born here should not be considered legal. Just because they are born in our country doesn't mean they automatically have the right to be considered an American citizen. Their parents snuck into our country, and I'm sorry that's not their fault, but they shouldn't be granted legal citizenship if that's the case. Their parents can just use them to gain citizenship. What if people were just coming over to have kids to gain citizenship? That's just wrong.

    2. I feel like if this act was passed, then people would stop coming in as much. We'd still have a huge flow of illegal immigrants, but i think that eventually it would stop because the parents can't use their children to gain citizenship for themselves.

  38. 1)I think that if a child is born in America, it is an american citizen, but it still has to pay taxes just like we do. If they will have a better life here than where they are from, why should we strip them of that?

  39. 1. I think if the baby is born in America then it is a citezen not the parents. One parent should be aloud to stay and pay taxes but not both.

  40. As early as the 17th century, people have been flocking to America to start a new life. Pilgrims came to America to evacuate from the Church of England and to pursue Puritanism.
    Today, people are still coming to America to escape poverty, war, crime, drugs, and religious persecution. If the 14th Amendment gets passed, children born to Illegal Immigrants in America will not be considered citizens.
    In my opinion, I think this is not fair. A child has no choice but to do as their parents do. Of course, the parent should know better than to illegally come into America, but how are the children being born? A hospital did not allow anyone to be served (although, now it is a law, since we have socialized healthcare). A child is merely innocent, and I believe that if the child has legal family, or friends of the parents, that can be guardians for the child, there should be no problem.

    If this amendment was passed, previous Illegal Immigrants who birthed children in America would have to be tried, since they would fall under this category. It is not fair to grandfather other Illegal Immigrant's children, but hinder the process of legalizing another's child.

  41. If a child is born in America it is an American citizen. Being born in whatever country makes that YOUR homeland, and it is wrong to just get that taken away from anybody so easily. Make it hard for illegal aliens to cometo merica and do that but if they risked there own lives; like we did, then their future generation deserves citizenship.
    Also, i think if this act ws passed a lot of crime would run our streets and boarders. Plus there still wouldn't be a big change in numbers as to illegal aliens and babies

  42. In my opinion if a child is born to illegal immigrants he should be considered illegal also. The fact that people are doing so many illegal things just to get their child to be a citizen is outrageous and needs to stop. If this amendment is passed at first America will have to deal with illegal immigrants still trying to get here. But if our boarder control steps up and does whatever it takes to stop it the country will be okay.
